Welcome to the website of Emma Cawston Fine Art (“we”, “us”, “our”). By placing an order through our website, you agree to the following Terms & Conditions and Privacy Policy. Please read them carefully before making a purchase.

1. Giclée Prints – Colour Disclaimer

Giclée prints may vary slightly in colour from what you see on your screen. This is due to differences in device displays, brightness settings, and colour calibration. We do not guarantee exact colour matching.

2. Refund & Returns Policy

2.1 Standard (Non-Custom) Products

We offer a 14-day refund policy in line with UK consumer regulations for eligible non-custom items.

To qualify:

  • Items must be unused, unopened, and in original packaging.

  • Returns must be made at the customer’s expense unless the item arrives damaged or faulty.

2.2 Damaged or Faulty Items

If your order arrives damaged:

  • Contact us within 48 hours of delivery.

  • Provide photo evidence of both the item and the packaging.

  • Once approved, we will offer a replacement or refund at no cost to you.

3. Custom Artwork

3.1 Deposit

All custom artwork commissions require a 50% non-refundable deposit at the time of booking. This covers materials and secures your place in the schedule.

3.2 Non-Refundable Status

Custom artwork commissions are non-refundable once work has begun, including in cases of change of mind.

3.3 Completion & Final Payment

Once the artwork is completed, photos will be shared for approval.
The remaining 50% balance must be paid in full before shipping can take place.

4. Framing Options

Framing is optional and treated as a separate service:

4.1 Custom Third-Party Frames

  • Custom frames are made by a third-party.

  • Payment for framing must be made in full before the frame can be ordered.

  • These frames are non-refundable once production has begun.

4.2 Repurposed Antique Frames

  • Repurposed antique frames are unique and completed by Emma Cawston directly.

  • Payment for this option can be included with your final payment for the artwork.

  • Availability of antique frames is limited and not guaranteed.

5. Shipping

5.1 Domestic Shipping (UK)

  • Domestic orders are shipped via Royal Mail.

  • Original artwork may use alternative couriers for insurance and safety reasons.

5.2 International Shipping

  • All international orders are shipped using equivalent international services.

  • Customs fees, duties, and taxes are the responsibility of the customer.

6. Intellectual Property & Copyright

All artworks, images, text, designs, and content on this website are protected by copyright law, including the Copyright, Designs and Patents Act 1988 and international copyright treaties.

6.1 Copyright Notice

All content on this website, including but not limited to artwork, illustrations, designs, images, text, logos, and products, is the property of Emma Cawston of Emma Cawston Fine Art and is protected by the Copyright, Designs and Patents Act 1988 and international copyright laws.

Permitted Use

You may:

  • View, share, and link to content for personal, non-commercial use only

  • Share images on social media with clear credit to [Emma Cawston of Emma Cawston Fine Art/ @Emma_cawston for instagram & Emma Cawston Fine Art of Facebook] and without alteration if artwork is shared without the correct tag can be subjected to investigation

Prohibited Use

You may not:

  • Reproduce, copy, trace, or modify the artwork

  • Use the artwork or products for commercial purposes

  • Sell, license, redistribute, or claim the work as your own

  • Use the artwork in AI training datasets, NFTs, or digital assets

  • Remove copyright notices or watermarks

Products

Purchase of a physical or digital product does not transfer copyright.
The copyright remains with Emma Cawston of Emma Cawston Fine Art at all times.
